Terms of Service

Adults only. LustMaker is intended only for people who are at least 18 and have reached the age of legal majority where they live.

These Terms of Service ("Terms") govern access to LustMaker at www.lustmaker.com and related services (together, the "Service"). LustMaker is operated by SparkShift Ltd. ("we," "us," or "our"). By creating an account, using the Service, submitting content for public review, or purchasing a product, you agree to these Terms, our Privacy Policy, and our Content Policy.

1. Eligibility and adult-only access

You may use the Service only if you are at least 18, have reached the age of legal majority where you live, and are legally able to enter into these Terms. Do not use the Service where adult services or the content you seek are prohibited. You are responsible for complying with local law.

2. The Service

LustMaker provides AI-assisted character creation, chat, image generation, video generation, and related features. AI output is synthetic, may be inaccurate or unexpected, and is not professional advice. Availability, features, models, and credit costs may change. We do not promise that any particular prompt will produce an output.

3. Accounts and security

You must provide accurate information, keep your credentials secure, and promptly notify us of suspected unauthorized use. You are responsible for activity performed through your account unless applicable law provides otherwise. You may not sell, transfer, automate access to, or misuse an account.

4. Credits and one-time purchases

Products currently identified on our checkout as credit packs are one-time purchases, not subscriptions. The checkout displays the quantity of credits, price, and currency before payment. Purchased credits are normally added after payment confirmation and expire one year after purchase unless the checkout states a different period or applicable law requires otherwise.

Credits are a limited, personal right to use eligible Service features. They are not money, stored value, transferable property, or redeemable for cash. Credit use and refunds are governed by our Refund Policy. Taxes, exchange rates, and charges imposed by your bank or payment provider may apply.

5. Future subscription products

These Terms allow us to offer a subscription in the future, but no product is a subscription merely because this section exists. A subscription applies only when the purchase page expressly labels the product as recurring and shows its billing interval, recurring price, benefits, renewal terms, and cancellation method before you choose to start it.

If you actively start a subscription, you authorize the disclosed recurring charges until cancellation. You will be able to cancel through the method shown at purchase or by contacting support. Cancellation stops future renewals and ordinarily does not end access already paid for. Any subscription-specific refund rights will be disclosed at checkout and remain subject to mandatory law.

6. Payments

Payments may be processed by third-party payment providers, including Verotel where offered. A provider may apply its own terms and privacy notice. Card details entered on a provider-hosted checkout are handled by that provider; LustMaker does not ask you to send us a full card number or security code. We may receive transaction identifiers, product, amount, currency, payment status, and limited billing or contact information needed to deliver credits, prevent fraud, reconcile payments, and provide support.

7. Your content and license

"User Content" includes prompts, character details, messages, uploaded files, generated media you save or submit, and reports or feedback. You retain whatever rights you lawfully hold in User Content. AI output may not be eligible for intellectual-property protection in every jurisdiction, and similar output may be produced for others.

You grant us a non-exclusive, worldwide, royalty-free license to host, reproduce, process, adapt, and transmit User Content only as reasonably needed to operate, secure, moderate, troubleshoot, and support the Service. If you request public visibility, the license also permits us to display and distribute the approved public version through the Service. Making a character private ends future public display, subject to reasonable cache-clearing time and legal retention.

You represent that you have the rights, permissions, and consents needed for your User Content and that each real person depicted in sexual content is an adult who consented to both the depiction and its distribution.

8. Content rules and public review

All use, including private use, must follow the Content Policy. Prohibited material includes sexualized minors or age-ambiguous persons, non-consensual sexual content, incest, bestiality, trafficking or exploitation, and unauthorized sexual depictions of real people.

Selecting "Public" is a request for review, not immediate publication. A new public submission remains private to its creator until an authorized reviewer approves the submitted version. An edit to approved public content requires a new review before the edited version can replace the approved public version. We may reject, quarantine, remove, restrict, or preserve evidence of content as needed to enforce policy or law.

9. Reports and complaints

You can report content through our content report form or follow our Complaint and Takedown Policy. Rights holders may use our Copyright Complaint Process. Reports must be truthful and made in good faith.

10. Prohibited conduct

You may not:

  • violate law, another person's rights, or the Content Policy;
  • evade access controls, moderation decisions, payment controls, or rate limits;
  • introduce malware, scrape the Service without permission, or interfere with its operation;
  • impersonate another person or misrepresent ownership, consent, age, or payment authority;
  • use the Service to facilitate abuse, exploitation, fraud, harassment, or unlawful activity; or
  • resell the Service or use output in a way that violates law or third-party rights.

11. Our intellectual property

The Service, its software, design, trademarks, and original materials are owned by us or our licensors. Except for the limited right to use the Service under these Terms, no rights are transferred to you.

12. Suspension and termination

You may stop using the Service at any time. We may suspend or terminate access, remove content, or limit features where reasonably necessary for security, payment risk, policy enforcement, legal compliance, or protection of users and third parties. Where appropriate, we may provide notice or an opportunity to appeal. Sections that by their nature should survive termination will survive.

13. Disclaimers

To the extent permitted by law, the Service is provided "as is" and "as available." We disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation. Nothing in these Terms excludes warranties or rights that cannot lawfully be excluded.

14. Limitation of liability

To the extent permitted by law, we and our suppliers will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, goodwill, or opportunities arising from the Service. Our aggregate liability for a claim will not exceed the amount you paid for the Service during the six months before the event giving rise to the claim. These limits do not apply where prohibited or to liability that cannot lawfully be limited.

15. Changes and availability

We may update the Service or these Terms. We will post the revised date and provide additional notice where required. Material changes apply prospectively from their stated effective date. Continuing to use the Service after that date means you accept the revised Terms.

16. Governing requirements

These Terms are subject to applicable law, including any mandatory consumer-protection rights in your place of residence. If one provision is unenforceable, the remaining provisions remain effective. A failure to enforce a provision is not a waiver.
